I would like to stress the importance of getting a new survery when purchasing a piece of property. I have always stressed to my buyer clients that when purchasing a new piece of property, you should always have it surveyed during the due diligence period. Why? To make sure nothing has changed with the property mainly with any encroachments that may have occured.
I have been representing buyers on piece of lake front property on lake glenville recently. The buyers took my advice and decided to have a survey completed. By doing this, we found out that the driveway of the home they were buying was encroaching on the neighbors piece of land. The sellers of this home had no idea. So know my buyers will wait to purchase the home until the sellers resolve the encroachment issue with the neighbor. This process can be easy or difficult depening on the neighbor.
But this was very possitve for my buyers as they could have inherited the encroachment issue if they did not get a survey before hand.
